Kolencherry Church Belongs to the Orthodox Faction - Court Order

In a major court order verdict, it has been stated that the St. Peter's and St. Paul's Orthodox Syrian Church purely belongs to the Orthodox faction and should be  administered as per 1934 Constitution. The court has also made it clear that the assigning of  Fr. Jacob Kurien as Church Vicar by Dr. Mathews Mar Severios Metropolitan is valid and the District Order doesn't need to be corrected.

On behalf of thi, the Kolencherry Church was opened by the believers and yers were conducted. Due to being closed for a long period, the Church is almost in a bad state and the cleaning of the church has been started by the believers. Meanwhile the Jacobite factions have already started protests and tension have raised near the Church vicinity.

The Kerala High Court on Friday upheld the Ernakulam District and Sessions Court’s order that Rev. Fr Jacob Kurian, the Orthodox faction vicar of the St Peter’s and St Paul’s Church in Kolenchery, is entitled to the keys of the church.

A Bench of Justice T R Ramachandran Nair and A V Ramakrishna Pillai passed the vital judgment, while disposing of an appeal that challenged the lower court’s ruling.

The appeal was filed by K S Varghese, V M George and C K Thampi.

The Sessions Court had held that the Supreme Court judgment in 1995 had approved the 1934 constitution of the Orthodox faction.

The Apex Court verdict was applicable to the Kolenchery church as well.

The session’s court had observed that the Patriarch’s group (Jacobite Faction) could not contend that the 1934 constitution was invalid.

Dismissing another plea to frame a scheme for the administration of the church, the Session’s Court held that the issue for a scheme did not arise in view of the Supreme Court’s verdict on the 1934 constitution.
